A Professional Fiduciary is a person who holds a legal or ethical relationship of trust with one or more other parties. A Trustee, for example, is a fiduciary entrusted with a person's trust assets for safekeeping, investment management and beneficiary distribution. There is a high standard of care owed by the fiduciary to those for whom they work.
The Fiduciary acts at all times solely in the best interest of the person to whom they owe the duty. This means that the Fiduciary will not undertake any action in which there is a conflict of interest, or which will otherwise place the Fiduciary's interest above that of the client. This Standard is codified in the California Probate Code.
California regulates the business of Professional Fiduciaries under the Business and Professions Code. The Professional Fiduciaries Bureau (within the Department of Consumer Affairs) oversees the business of the Fiduciary including licensing requirements, reporting requirements and adherence to the Fiduciary Standard.
